Failure to Yield to a Pedestrian

  • Motorist must yield to any pedestrian crossing the road on which they are traveling where the pedestrian has the right of way and is legally in the crosswalk.   

  • An accident with a pedestrian in a crosswalk is sufficient evidence that a motorist failed to yield to that pedestrian.

Failure to Yield to a Vehicle

  • Motorist approaching an intersection must yield the right of way to a vehicle which has entered the intersection from a different highway. 
  • When two vehicles enter an intersection from different highways at approximately the same time the motorist of the vehicle on the left must yield the right of way to the vehicle on the right.
