One concern most clients have after receiving a ticket is the number of points they will receive on their record. The Driver Violation Point System gives the DMV a system for taking action against high risk drivers, essentially keeping them off the road if they have accrued too many points. If a driver racks up 11 points in an 18-month period, the driver’s license can be suspended.

The number of points depends on the nature of the crime. For a speeding ticket in the State of New York, you can expect the following:

  • 1-10 MPH over posted limit: 3 points

  • 11-20 MPH over posted limit: 4 points

  • 21-30 MPH over posted limit: 6 points

  • 31-40 MPH over posted limit: 8 points

  • More than 40 MPH over: 11 points

 

Failure to signal, making an improper turn, or disobeying a traffic control device will result in 2 points. 3 points is typically assigned for running a red light, disobeying traffic control signs, improper passing and changing lanes unsafely, driving in the wrong direction, or a child safety restraint violation. 5 points is typically assigned for the following: reckless driving, failing to stop for a school bus, improper cell phone use, texting, as well as a railroad crossing violation.

 Drivers Responsibility Assessment Fee (DRA)

As per the Department of Motor Vehicles, there are three reasons why a motorist would be subjected to the DRA.  The following are those reasons:

      1)  Drug or drunk driving offense - minimum DRA is $750 (1st offense) 

      2)  Chemical Test Refusal - minimum DRA is $750 (1st offense)  

      3)  6 or more points on your driving record ($300 for first 6pts, then $25 each additional point)

*** DRA is payable over three years - For example, $750 DRA is payable $250 per year for three years

Suspension

A motorist license is automatically reinstated after the term of suspension is finished (given your license has not expired in the interim).

Revocation 

 A motorist must reapply for your license and repay all fees, at that point you only have a right of reinstatement, DMV can deny you a license when you reapply .
